1. Introduction
Welcome to CrushOn! These Terms of Service ("Terms") govern your use of the CrushOn mobile application and any related services offered by CrushOn ("CrushOn Services"). Please read these Terms carefully as they form a binding legal agreement between you and CrushOn.
By creating an account or accessing our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the CrushOn Services.
2. Eligibility
You must be at least 18 years old to use the CrushOn Services. By using CrushOn, you represent and warrant that you are 18 years of age or older.
You also represent and warrant that you:
Have not been convicted of a felony or sex crime in any applicable jurisdiction.
Are not required to register as a sex offender.
Are not prohibited from using the Services under applicable laws.
Will comply with these Terms and all applicable laws and regulations.
CrushOn does not allow behavior that endangers minors or promotes violence, self-harm, or harm to others. If you encounter a user you believe is underage or violating these standards, please report them immediately via the in-app reporting function or by emailing us at anandhiadadhi25@gmail.com.
3. Account Registration and Security
To use certain features, you must register for an account. You agree to provide accurate and complete information during registration and to keep it updated.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately at anandhiadadhi25@gmail.com of any unauthorized use of your account. CrushOn is not liable for any losses arising from unauthorized account use, but you may be liable for losses incurred by CrushOn or others due to such use.
You may not share, transfer, or sell your account. CrushOn reserves the right to disable your account at any time for any reason, including violation of these Terms.
4. User Conduct and Prohibited Activities
You agree to use CrushOn Services lawfully and only for their intended purpose. You are strictly prohibited from:
Posting content that is illegal, obscene, defamatory, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that could be considered a criminal offense.
Posting content that infringes on any third party's intellectual property, privacy, or other rights.
Posting unsolicited advertising, spam, or engaging in commercial activities without our consent.
Impersonating any person or entity or misrepresenting your affiliation.
Uploading viruses or malicious code or engaging in activities that could disrupt, damage, or interfere with the Services.
Harassing, stalking, or harming other users.
Using the service for any fraudulent purpose.
Attempting to gain unauthorized access to the Services or other users' accounts.
5. User-Generated Content
CrushOn allows you to post content, including text, images, and videos ("User-Generated Content" or "UGC"). You retain ownership of your UGC, but by posting it, you grant CrushOn a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and modify your UGC solely for the purpose of operating, promoting, and improving the CrushOn Services.
You are solely responsible for your UGC and its legality, reliability, and appropriateness. CrushOn does not endorse any UGC and disclaims all liability related to it. We reserve the right to remove any UGC that we believe violates these Terms.
The license you grant terminates when you delete your UGC or account, except for uses reasonably necessary for CrushOn to operate (e.g., backup copies).
6. Intellectual Property
The CrushOn Services, including all content (other than your UGC), trademarks, logos, and software, are the property of CrushOn or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use. You may not copy, modify, or create derivative works without our express written permission.
7. Paid Services
CrushOn may offer optional paid services ("Paid Services"). Fees for Paid Services are stated within the app and are subject to change. All fees are non-refundable except as required by law or at CrushOn's sole discretion in cases of technical errors.
Payment for Paid Services is processed by third-party payment providers. Your payment relationship is governed by their terms and privacy policies. CrushOn is not responsible for errors by payment providers.
8. Third-Party Links and Content
The CrushOn Services may contain links to third-party websites or services. CrushOn does not endorse and is not responsible for the content or practices of any third-party sites. Your interactions with these third parties are solely between you and them.
9. Termination
You may terminate your account at any time. CrushOn may suspend or terminate your access to the Services immediately, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately.
10. Disclaimer of Warranties
THE CrushOn SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CrushOn DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CrushOn DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CrushOn SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
IN NO EVENT SHALL CrushOn'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO CrushOn IN THE PAST SIX MONTHS, OR $50, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless CrushOn, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Services, your UGC, or your violation of these Terms.
13. Changes to Terms
CrushOn may modify these Terms at any time. We will notify you of changes by posting the new Terms within the app or via email. Your continued use of the Services after the changes become effective constitutes your acceptance of the new Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of [State], USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved through final and binding arbitration in [City, State], unless prohibited by law.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms constitute the entire agreement between you and CrushOn regarding the Services.
