1. Introduction
Welcome to Lumy! These Terms of Service ("Terms") govern your use of the Lumy mobile application and any related services offered by Lumy ("Lumy Services"). Please read these Terms carefully as they form a binding legal agreement between you and Lumy.
By creating an account or accessing our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Lumy Services.
This Clause applies to all minors (under 18 years old) using the Application. Children under 13 years old shall comply with the COPPA (Children's Online Privacy Protection Act) additionally, teenagers under 16 years old in the European Union shall follow the GDPR-K (General Data Protection Regulation for Kids) requirements, and users worldwide shall uniformly meet the Google Play Families Policy standards.
The sole legal basis for age verification is the Google Play Age Signals API. The Application will not independently collect date of birth information, infer age through SDKs, or guess users' age relying on third-party data.
If a user is verified as a minor via the API, age-appropriate permission restrictions and privacy protection mechanisms will be automatically triggered without requiring additional operations from the user.
In the target audience settings of Google Play Console, the Application has clearly marked the applicable age groups, and will not indirectly attract non-target age children through imagery or terminology.
Application content is adapted into five levels: "5 years old and below, 6-8 years old, 9-12 years old, 13-15 years old, 16-17 years old". Minors may only access compliant content corresponding to their age group, and are prohibited from accessing inappropriate information such as violence, pornography, and gambling.
Advertising content maturity strictly matches the Application's rating and shall not exceed the Application's own rating standard. Personalized advertising is prohibited for children under 13 years old, and only contextually targeted age-appropriate advertising may be displayed.
Advertising SDKs have been updated to compliant versions: Android devices use GMA SDK 20.6.0 or above, and iOS devices use GMA SDK 7.67.0 or above. Sensitive identifiers such as advertising IDs will not be transmitted to children or users with unknown age.
The Application only uses advertising SDKs certified as compliant with Google Play Families Policy, and automatically blocks ad sources that have not passed Google's self-certification.
The collection of minors' personal information is limited to the minimum scope necessary to provide services, including but not limited to device type and necessary account identifiers. Information unrelated to the services will not be collected.
Before collecting information from children under 13 years old, explicit consent from guardians must be obtained through Google Play Family Link or other verifiable methods, and the purpose, storage period, and scope of use of the information collection must be clearly informed.
Minors' data is stored in encrypted form, with restricted access permissions for internal personnel. The storage period shall not exceed the time necessary for providing services. The data will be deleted immediately upon termination of the service or at the request of guardians.
When entrusting third parties to process minors' information, a security agreement must be signed, explicitly prohibiting third parties from re-entrusting or disclosing the data. After the termination of the entrustment relationship, third parties shall be required to delete the relevant information immediately.
Guardians may set content access restrictions and in-app purchase limits through Google Play parental control functions. All in-app purchase behaviors by minors must be authorized and confirmed by guardians.
The Application has a built-in dedicated feedback portal, supporting users (including guardians) to report Child Sexual Abuse Material (CSAM), inappropriate content, or violating behaviors. The Platform commits to responding and handling reports within 24 hours of receipt.
Guardians have the right to inquire about and correct minors' personal information, and request the deletion of improperly collected information or information exceeding the necessary scope. The Platform shall provide convenient operation paths and customer service support.
The Application has formulated and published prohibited standards for Child Sexual Abuse and Exploitation (CSAE), and appointed a dedicated child safety contact person. Contact information can be found in the Application's settings page.
If CSAE-related content is discovered, the Platform will immediately remove it and report it to the relevant authorities (such as the National Center for Missing & Exploited Children in the United States) in accordance with legal requirements.
Users who fail to comply with this Clause and Google Play child safety policies may have their functions restricted or accounts suspended by the Platform. If the Application has compliance vulnerabilities, rectification shall be completed within the specified time limit to ensure compliance with policy requirements.
If the Application's target age group is changed or new advertising and in-app purchase functions are added, existing users will be notified through application update descriptions or in-app notifications.
3. Account Registration and Security
To use certain features, you must register for an account. You agree to provide accurate and complete information during registration and to keep it updated.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately at anandhiadadhi25@gmail.com of any unauthorized use of your account. Lumy is not liable for any losses arising from unauthorized account use, but you may be liable for losses incurred by Lumy or others due to such use.
You may not share, transfer, or sell your account. Lumy reserves the right to disable your account at any time for any reason, including violation of these Terms.
4. User Conduct and Prohibited Activities
You agree to use Lumy Services lawfully and only for their intended purpose. You are strictly prohibited from:
Posting content that is illegal, obscene, defamatory, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that could be considered a criminal offense.
Posting content that infringes on any third party's intellectual property, privacy, or other rights.
Posting unsolicited advertising, spam, or engaging in commercial activities without our consent.
Impersonating any person or entity or misrepresenting your affiliation.
Uploading viruses or malicious code or engaging in activities that could disrupt, damage, or interfere with the Services.
Harassing, stalking, or harming other users.
Using the service for any fraudulent purpose.
Attempting to gain unauthorized access to the Services or other users' accounts.
5. User-Generated Content
Lumy allows you to post content, including text, images, and videos ("User-Generated Content" or "UGC"). You retain ownership of your UGC, but by posting it, you grant Lumy a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and modify your UGC solely for the purpose of operating, promoting, and improving the Lumy Services.
You are solely responsible for your UGC and its legality, reliability, and appropriateness. Lumy does not endorse any UGC and disclaims all liability related to it. We reserve the right to remove any UGC that we believe violates these Terms.
The license you grant terminates when you delete your UGC or account, except for uses reasonably necessary for Lumy to operate (e.g., backup copies).
6. Intellectual Property
The Lumy Services, including all content (other than your UGC), trademarks, logos, and software, are the property of Lumy or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use. You may not copy, modify, or create derivative works without our express written permission.
7. Paid Services
Lumy may offer optional paid services ("Paid Services"). Fees for Paid Services are stated within the app and are subject to change. All fees are non-refundable except as required by law or at Lumy's sole discretion in cases of technical errors.
Payment for Paid Services is processed by third-party payment providers. Your payment relationship is governed by their terms and privacy policies. Lumy is not responsible for errors by payment providers.
8. Third-Party Links and Content
The Lumy Services may contain links to third-party websites or services. Lumy does not endorse and is not responsible for the content or practices of any third-party sites. Your interactions with these third parties are solely between you and them.
9. Termination
You may terminate your account at any time. Lumy may suspend or terminate your access to the Services immediately, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately.
10. Disclaimer of Warranties
THE LUMY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LUMY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUMY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LUMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
IN NO EVENT SHALL LUMY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO LUMY IN THE PAST SIX MONTHS, OR $50, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Lumy, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Services, your UGC, or your violation of these Terms.
13. Changes to Terms
Lumy may modify these Terms at any time. We will notify you of changes by posting the new Terms within the app or via email. Your continued use of the Services after the changes become effective constitutes your acceptance of the new Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of [State], USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved through final and binding arbitration in [City, State], unless prohibited by law.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms constitute the entire agreement between you and Lumy regarding the Services.
